False Defamation Results in Jail Time

Woman in 30s Jailed for False Rape Allegation; Legal Consequences Escalate

A woman falsely accused her supportive father of rape for refusing to give her money, leading to a prison sentence.

The Uijeongbu District Court's Namyangju Branch sentenced a woman, A, in her 30s, to 10 months in prison for defamation, business obstruction, and insult, as presided over by Judge Choi Chi-bong.

A was charged for posting 11 defamatory messages about her father, B, on an online forum last May and June, claiming to be a victim of familial sexual violence.

She falsely alleged lifelong sexual assault by her father, domestic violence against her mother, a 30 million won settlement, and demanded harsh punishment.

A revealed B's name and business details, causing him professional difficulties.

A also accused B online of marrying C, a woman with whom he allegedly had an affair.

In February 2021, A sued B for sexual assault damages in the Incheon District Court, failing to prove any wrongdoing.

A claimed her statements were true during the criminal trial, but the court rejected this, citing a lack of evidence and the lawsuit's outcome.

The court found A's accusations false, noting her financial support from B during and after her studies and that she accused him after he declined to fund her café.

The court stated A spread falsehoods due to financial refusal, irreparably damaging the victims' reputations.

The court explained the sentence by noting A's continued similar posts, potential for reoffending, and the victims' demand for severe punishment.
